Judge Rules Health Law Unconstitutional (Politico)

A federal judge on Monday ruled that the entire health care overhaul is unconstitutional, but he stopped short of ordering the federal government to stop implementing it.

Judge Roger Vinson ruled that Congress overstepped its legal bounds when it included the provision requiring nearly all Americans to buy insurance. Because the provision is key to the rest of the law, he declared the whole thing unconstitutional.

Last year, a Virginia judge knocked down the key piece of the law, but he didn’t declare the whole law unconstitutional.

Vinson said the Congress has no right to require Americans to purchase a product.

“Because the individual mandate is unconstitutional and not severable, the entire Act must be declared void. This has been a difficult decision to reach, and I am aware that it will have indeterminable implications,” he wrote in his ruling.

Indeterminable implications?  Only to the committed socialists who passed the damnable thing in the first place.

    If it goes to the Supreme Court, God only knows what we will end up with.
    The implications as far as the future of the left goes is obvious.
    If this one bill is struck down and eliminated, it will virtually kneecap the leftist liberal agenda for years to come.
    Cass Sunstien is salivating over the power that he would manipulate if ObamaCare is passed.
    Now is the time.
    Defeat of the bill is the only option.

    Indeterminable, … well that depends on who’s in charge.
    Another attempt to confuse the ill-informed.
    The future is in our hands.

    Obamacare is unconstitutional. Everybody seems to understand that except Nancy Pelosi, Harry Reid and President Obama.

    Yesterday, Florida federal district Judge C. Roger Vinson became the second jurist to rule Congress has no authority to force Americans to buy a particular product such as health insurance. When that was suggested last year to then-Speaker Pelosi, she incredulously asked, “Are you serious?” Liberals sneered at the notion that the Constitution imposes any limits on congressional power or that the old document is even relevant.

    On Dec. 13, Virginia federal district Judge Henry E. Hudson ruled the individual mandate not just unconstitutional but also dangerous because it, “would invite unbridled exercise of federal police powers.” Judge Vinson added to that reproof, ruling the mandate didn’t pass muster, wasn’t severable from the rest of Obamacare and that therefore the entire law is unconstitutional and “must be declared void.”

    “Never before has Congress required that everyone buy a product from a private company (essentially for life) just for being alive and residing in the United States,” Judge Vinson wrote. “If it has the power to compel an otherwise passive individual into a transaction … it is not hyperbolic to suggest that Congress could do almost anything it wanted.” He warned that the Obama administration’s logic could give government the right to interfere into “even personal decisions about whether to marry, whom to marry, or whether to have children.”

    It has been stated that this may take a year to get to the Supreme Court, depending upon the number of appeals the DOJ throws out.
    Justice Ginsberg is a ? mark as far as how long she can or wants to perform her duties.
    Obama may have the time left to replace her with another liberal, and I’m sure he has plenty more in mind.
    This scenario could come right down to the wire.
    We are not out of the woods yet on this issue by a long shot.
